3. Account Registration

To purchase Products, you must create an account providing accurate information including your name, email address, and shipping address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Products and Pricing

4.1 Product Descriptions

We sell officially licensed limited edition fine art pieces. All product descriptions, images, and specifications are provided for informational purposes and may be subject to change.

4.2 Limited Edition Nature

Our Products are limited edition pieces. We maintain internal systems to prevent overselling; however, if a limited edition piece becomes unavailable after your order, we will provide a full refund.

4.3 Pricing

All prices are listed in U.S. dollars and are subject to change without notice. The price charged will be the price in effect at the time of purchase.

5. Production and Delivery

5.1 Processing Times

Production and delivery times vary by product type:

• Canvas Gallery Wraps: 6-10 Days
• Standard Numbered: 13-17 Days
• Jewel Edition: 13-17 Days
• Estate Edition: 17-21 Days

These timeframes begin after payment confirmation and are estimates, not guarantees.

5.2 Shipping Restrictions

We ship to select geographic locations. Shipping availability may vary based on licensing agreements and operational capabilities. Contact us for specific shipping information to your location.

5.3 Shipping Damage and Lost Packages

Claims for shipping damage or lost packages will be handled on a case-by-case basis. Report any issues immediately upon delivery or expected delivery date.

6. Payment and Refunds

Payments are processed through Shopify's secure payment system. By providing payment information, you authorize us to charge the specified amount for your purchase.

6.2 Order Cancellation

We reserve the right to cancel orders due to product unavailability, payment issues, or other circumstances. Cancelled orders will receive full refunds.

7. Returns and Satisfaction Guarantee

7.1 30-Day Satisfaction Guarantee

We stand behind every custom piece. You may return your purchase within 30 days of delivery for any reason, subject to the following conditions:

• Products must be returned in original condition
• Customer is responsible for return shipping costs unless the return is due to our error
• Refunds will be processed within a reasonable time after we receive the returned item

8. Intellectual Property Rights

When you purchase a Product, you acquire ownership of the physical art piece only. You do not acquire any rights to the underlying intellectual property, including but not limited to:

Each Product includes a printed certificate of authenticity. This certificate verifies the authenticity of your purchase but does not grant intellectual property rights.

• Remove or alter any copyright notices or proprietary markings

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ART BRAND STUDIOS, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT of OR RELATING TO THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Art Brand Studios, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of our services or violation of these Terms.

13. Dispute Resolution and Arbitration

YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN US AND YOU INDIVIDUALLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada and the United States, without regard to conflict of law principles.
